Terms of Service

Dear users (hereinafter referred to as "users", "you"), welcome to LokShorts! Before you log in, access or use the LokShorts products and services (hereinafter referred to as "Service", "LokShorts") provided by this platform and its affiliates (hereinafter referred to as "we", "us", "our"), please read the User Terms of Service (hereinafter referred to as "Terms") carefully, particularly those sections that may limit our liability or pertain to your significant rights. If you do not agree with our terms, you may not use the Service. Your use and/or continued use of the Service signifies your acceptance of all terms of the Service.

You affirm to us that you are an adult and possess full legal capacity. If you are a minor or lack full legal capacity, you will not be permitted to register, log in, or use the Service. These Terms encompass the following terms and conditions, the agreements explicitly contained herein, and all rules that we may announce in the future. All these rules are considered an integral part of the Terms and have the same legal effect. Unless explicitly stated otherwise, your use of the Services signifies your agreement to be bound by these Terms, forming a legally binding contract between you and us.

We retain the right to modify and/or amend these Terms periodically by posting notices and/or through other reasonable means. You are encouraged to regularly check the revised Terms, which you must comply with when using the Services. Your continued use of our Services signifies your acceptance of the revised Terms. Any dispute between you and LokShorts shall be governed by the latest Terms. If you disagree with the revised Terms, you must cease using the Services.

Account

To use the service, you must create an account approved by us and log in. If you access the service through a third-party account approved by us, you must ensure the reliability, authenticity, and availability of the account. If you are unable to log in to LokShorts due to a third-party account issue (such as the account being suspended), please contact the company that owns the account. Your account number will be the sole reference for us to verify your identity.

You should bind your account using your Email Account (one Email Account can only register one account). Please register your account with an Email Account that has not been linked to your LokShorts account and has not been suspended by us. The method of account registration and binding may change according to user or product needs, and you agree to comply with such changes that meet local laws and regulations. You agree that we will use the mobile phone number you provide and/or the mobile phone number and mobile device identification code we automatically extract when you register.

You can decide whether to authorize us to disclose and use your location information when registering. If you grant us such permission, we will provide you with more personalized services based on your location. If you do not grant us such permission, you will still be able to use the basic functions and services we provide, though it may affect related services based on location information.

When you register, log in, or use LokShorts, we need to collect personal information from you that can identify you, so that we can contact you or provide you with a better User Experience when necessary. You agree to provide true, detailed, and accurate personal data ("Personal Data") with your consent. Personal Data may include, but is not limited to, username, gender, age, date of birth, ID, address, occupation and industry, height, weight, income, interests, personal data, and other information you register/update. You agree to promptly update any changes to your personal information. If the personal information you provide is inaccurate, false, or contains illegal/objectionable information, we may reject your registration application and terminate your use of the Service.

You agree not to:

(1) Use any false information to register your own LokShorts account;
(2) Without relevant permission, register your own LokShorts account in the name of others;
(3) Register your LokShorts account excessively;
(4) Register and maintain more than one LokShorts account during the same period.

If you use false information to fraudulently use a registered account, or your account profile photo, personal profile, and other information contain illegal/harmful content, we have the right to take measures such as notifying you to correct or suspend the use of your account within a specified period; we have the right to cancel an account registered in the name of another person or in bad faith and report it to the competent government department.

You acknowledge that: You are fully competent and legally capable of agreeing to these Terms of Service in accordance with the laws and policies of each country, and you are able to independently bear responsibility for your use of the services we provide. If you do not have the above ability and ability, it is recommended that you read these Terms of Service accompanied by your guardian. You may not use the Services unless your guardian agrees with your use of the Services and these Terms of Service. If you are liable under applicable law or these Terms of Service, we will revoke our right of recourse to your guardian. The username, nickname, icon, and other account info you fill in, log in, or use during the use of the service shall not violate the provisions of laws and regulations, national systems, national interests, legitimate rights and interests of citizens, public order, or social morality, and always provide true information. Any illegal or harmful information is prohibited. You further guarantee that the account info you fill in, log in, or use shall not contain the following: Violating the provisions of the Constitution and other laws and regulations; Endangering national security, state secrets, state power and/or national unity; Damage to national honor, interests or social public interests; Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity; Violating state religious policies, propagating cults or superstitions; Spreading rumors, disturbing social order or stability; Spreading, pornography, gambling, violence, murder, terror, or abetting crime; Insulting or slandering others or harming the legitimate rights and interests of others; Other aspects prohibited by laws and regulations. If the account information such as the account icon, nickname, etc. you log in or use contains illegal or harmful information, we have the right to notify you to correct or suspend the use of your account within a time limit or take other actions against you. If you log in, use, or fill in your username, nickname, icon as any entity or celebrity, we have the right to disable the account and report it to the competent government department. You must keep your account and password secure, or you will be solely responsible for any damages caused by you, us, or any third party. You agree that you will be solely responsible for all activities and events that occur under your account. You may change the password for your account at any time. You agree to notify us immediately if you know or suspect that your account is being used unlawfully or that there is an error.

Service Guide

You agree not to misuse the Services. You warrant that you will use the Services within the bounds of laws and regulations and these Terms and will not engage in any harmful, illegal, or infringing acts; otherwise, you shall bear full responsibility for all consequences. Additionally, you shall fully indemnify us or any third party for any losses caused by the above violations.

You agree to comply with the applicable laws and regulations and local ethical and cultural customs in your jurisdiction during the use of the service. Otherwise, you will be fully responsible for this. Moreover, please use the service appropriately and responsibly. If your actions cause us to violate laws and regulations or involve us in political or public events, we have the right to suspend or terminate the service.

In any event, you agree not to:

(1) Use the Services for any illegal activity;
(2) Use the Services for any activity that is or is likely to be harmful to minors;
(3) Send Email Spam, Junk Email, or assist others in sending Email Spam, Junk Email from your account;
(4) Display any inappropriate text, audio, or video (such as pornography, violence, vulgarity, terror, barbarism, and other content that violates laws and regulations, social morality, or national cultural traditions/customs);
(5) Engage in any false or misleading activity (such as attempting to solicit cash by fabricating false reasons or impersonating another person);
(6) Perform any act that is detrimental to the Services or others (e.g., post or distribute viruses, stalk, discriminate, post hate speech/abusive comments, promote violence against others, or cruelty to animals);
(7) Infringe the rights of others (such as uploading, storing, or posting manuscripts, music, photos, or videos that are the intellectual property of unauthorized third parties); Infringe on the privacy of others (such as secretly photographing others);
(8) Use the Services in any way that may interfere with, impair, affect, or limit the proper use of the Services by other users, or in any way that may cause damage, disable or excessive use of the Services or interfere with the proper functioning of the Services;
(9) Send any unsolicited or unauthorized advertising, solicitation messages, promotional materials, Email Spam, Junk Email, chain letters, or pyramid schemes, or conceal or misrepresent the identity of the sender for the purpose of sending Email Spam, Junk Email, or commercial email;
(10) Obtain or collect email addresses, phone numbers, IM numbers, and other information from other users without their consent;
(11) Use any robot, spider, crawler, scraper, or other automated means to access our services or collect data;
(12) Reverse Engineer or obtain the source code of the Service in any way, or circumvent or circumvent measures implemented to prevent or restrict access to any area, content, or code of the Service; Use or attempt to use any unauthorized account; Impersonate or post information on behalf of any other person or entity, or misrepresent your affiliation with any other person or entity; Attempt to circumvent any content filtering technology that we may use, or attempt to access any services or areas that you do not have access to; Place any advertising to recommend products or services outside of LokShorts and its affiliates. You also agree not to solicit our users to use similar competitive products or Services for any reason or in any way; Engage in any activity that violates any laws, regulations, policies, or rules of LokShorts or is detrimental to us and/or other users. You acknowledge and agree that you will not use the Services for sale or any other commercial purposes without our affirmative consent. If you wish to use the Services for commercial purposes, please give us written notice and obtain official authorization. You agree to be responsible for your actions during the use of the service, including but not limited to direct compensation to the infringed party, and/or full compensation for our losses if your actions cause us to bear administrative penalties or infringement damages. For any violation of the above provisions, we may immediately suspend or terminate your access to some or all of the services at our sole discretion, including freezing or canceling your access to your account and/or deleting your user content. You acknowledge and agree that we may, at the request of the competent department, provide the necessary information you submit or store on the LokShorts server during the use of the service to the competent department. After our preliminary assessment, if you are suspected of infringing on the legitimate rights and interests of others, we may provide the above-mentioned necessary information to the relevant right holder. Any other devices (such as PCs, mobile phones, and devices connected to the internet or network) and their costs (such as phone bills, internet connection fees, or mobile network fees) related to this service will be borne by you.

You acknowledge that we may publish commercial advertisements and other commercial information in several ways in the course of providing the Services. You agree that we may provide you with such information by sending emails, private messages, or otherwise. Unless otherwise expressly provided in these Terms, all new products, features, and services introduced by LokShorts shall be governed by these Terms.

Ownership and Exercise of Rights

All intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, and any other proprietary rights related to LokShorts, are owned by us or our licensors. Except as expressly provided in these Terms, no license or other rights to the intellectual property are granted to you. You agree not to infringe upon our intellectual property rights or those of our licensors. Any unauthorized use of our intellectual property rights is a violation of these Terms and may also violate applicable laws, including without limitation copyright and trademark laws and applicable communications regulations and statutes.

The Service and all content displayed on LokShorts (including but not limited to trademarks, logos, marks, applications, source code, programming interfaces, web pages, text, images, audio, video, graphics, and when you use the Service) Ownership and intellectual property rights (including but not limited to copyrights, trademarks, and patents) belong to LokShorts or other rights holders. Unless otherwise agreed, you agree not to use, modify, copy, distribute, change, transmit, or publish the above content without our written consent, otherwise you are responsible for indemnifying us or other rights holders for all losses caused by it.

We are committed to respecting the privacy of our users and may collect, store, use, disclose and protect your personal information in accordance with our Privacy Policy. The detailed policy can be found in the Privacy Policy, and we encourage you to read it carefully.

General terms

Force Majeure: We do not assume any responsibility for any damage or loss caused by force majeure. For the purposes of this Agreement, force majeure includes force majeure, changes in laws and regulations or government orders, specific causes due to the characteristics of internet services, such as failures attributable to domestic and/or foreign basic telecommunications operators, computer or Internet-related technical defects, Internet coverage restrictions, computer viruses, hacker attacks, and other unforeseen, unavoidable and insurmountable situations to the extent permitted by laws and regulations.

Changes

As LokShorts and user experiences are constantly evolving, we may from time to time add, change or remove features from Services ("Updated Terms"), including in relation to whether a feature or Service is free of charge, to address a security threat or where there have been legal or regulatory changes that impact these Terms, and other business-related needs. We will not reduce your rights under any updates to the Terms without your explicit consent.

You agree that we may take any such actions at any time in our sole discretion. For changes to the Terms or to the Services that we need to make to meet security, safety, legal or regulatory requirements, we may not be able to notify you in advance. Where we consider that any changes to any content or features accessible within Services are reasonably material, we will (where reasonably practicable) notify you via inbox message or by posting the changes on our website. Any changes to this Agreement will become effective immediately upon posting by us, unless we specify otherwise.

AS YOU ARE NOT ALLOWED TO USE THE SERVICES IF YOU DO NOT AGREE TO FOLLOW THESE TERMS, IF YOU CONTINUE TO ACCESS OR USE THE SERVICES AFTER WE HAVE POSTED THE UPDATED TERMS, WE WILL CONSIDER THAT YOU HAVE ACCEPTED AND AGREED TO BE BOUND BY THE UPDATED TERMS. IF YOU DO NOT AGREE TO THE UPDATED TERMS, YOU MUST STOP ACCESSING OR USING THE SERVICES AND CLOSE YOUR ACCOUNT (IF APPLICABLE).

Disclaimer

LokShorts makes no guarantee that your use of the Services, and all other features or functionalities associated with the Services will be available, uninterrupted, interference-free, or error-free, or be free from any viruses, worms, or other security intrusions. You understand and agree that you use the Services, and use, access, download, or otherwise obtain materials or content through our Services and any associated services, at your own discretion and risk, and that you are solely responsible for any damage to your property (including your computer system or mobile device used in connection with our Services), or the loss of data that results from the use of the Service or the download or use of that material or content.

LokShorts does not guarantee the availability, delivery, performance, pricing, or punctuality of any content or other intellectual property appearing in our Services.

You understand and agree that LokShorts is not liable for any failure of performance due to any cause beyond its control, including, without limitation, acts of God, fire, explosion, vandalism, terrorism, weather disturbances, national emergencies, riots, wars, labor difficulties, supplier failures, shortages, breaches, action or request by any government, suspension of existing service in compliance with any applicable laws and regulations.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING AND TO THE EXTENT PERMISSIBLE BY LAW, WE MAKE NO WARRANTY THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR THE SERVICE OR USER CONTENT WILL BE VIEWABLE TO YOU; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE OR THAT ERRORS WILL BE CORRECTED; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR ANY LokShorts CONTENT OR USER CONTENT WILL BE ACCURATE OR RELIABLE; OR (D) THAT ANY CONTENT YOU SUBMIT WILL BE ACCESSIBLE ON OUR SERVICES. USE OF OUR SERVICES IS ENTIRELY AT YOUR OWN RISK AND YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHILE USING THE SERVICES.

YOU FURTHER ACKNOWLEDGE AND AGREE THAT IN NO EVENT SHALL LokShorts BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF THE SERVICES. LokShorts SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, LEGAL FEES AND COURT COSTS) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH: (I) THE USE OF OR INABILITY TO USE THE SERVICES, OR ANY INFORMATION AND CONTENT CONTAINED THEREIN; (II) YOUR PARTICIPATION OR RELIANCE ON ANY INFORMATION AND CONTENT ACCESSED IN CONNECTION WITH THE SERVICES; (III) ANY OTHER MATTER RELATING TO THE SERVICES AND/OR ANY INFORMATION AND CONTENT, REGARDLESS OF WHETHER ANY OF THE FOREGOING IS DETERMINED TO CONSTITUTE A FUNDAMENTAL BREACH OR FAILURE OF ESSENTIAL PURPOSE.

TO THE EXTENT THIS LIMITATION ON LIABILITY IS PROHIBITED, LokShorts'S SOLE OBLIGATION TO YOU FOR DAMAGES SHALL BE LIMITED TO US$1.00 (OR THE EQUIVALENT IN ANY OTHER CURRENCY).

Notices:Our communications related to the Services will be sent electronically. We will communicate with you by email or sending inbox messages. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

These Terms are governed by the Hong Kong Special Administrative Region of the People's Republic of China laws of each country, without considering the principle of conflict of laws. In the event of any conflict between these Terms and the laws of each country, the provisions of the national law shall prevail. In such a case, the relevant content shall be modified or reinterpreted in accordance with the provisions of the law, and the validity of the rest of these Terms shall remain unchanged. Any dispute arising out of or in connection with these Terms shall be submitted to the Hong Kong International Arbitration Centre ("HKIAC") for arbitration in accordance with its rules in force at the time. The language of arbitration shall be English, and the arbitral tribunal shall consist of three arbitrators. The arbitral award shall be final and binding on the parties.

These terms are effective as of the date of posting and constitute the entire agreement between you and LokShorts.

Our failure to exercise, delay in exercising, and partial exercise of our rights under the law and the Terms shall not be deemed a waiver of such rights nor shall it prejudice our future exercise of such rights.
